Beth Macaulay Couture General Terms & Disclaimers Policy
This General Terms & Disclaimers Policy sets out the foundational rules that govern all engagements with Beth Macaulay Couture (“BMC”). It outlines the scope of services, customer obligations, limitations of liability, and disclaimers related to sizing, colours, and timelines. By engaging with BMC, clients acknowledge and accept these Terms as binding and enforceable.
By placing an order, booking a consultation, or otherwise engaging with BMC’s services (online or in-person), clients acknowledge and agree to be bound by this Policy, alongside BMC’s General Terms & Disclaimers.
BMC reserves the right to update this Policy to reflect changes in law, industry practice, or operational requirements.
1. INTRODUCTION
1.1. These Purchase Conditions (together with any documents referred to herein) govern the use of Beth Macaulay Couture’s channels (studio, website, and official social pages) and the purchase of items or services from us (“Terms”).
1.2. Please read these Terms together with our Privacy & Cookies Notice (the “Data Policies”) before placing an order or booking a consultation. By proceeding, you agree to be bound by these Terms and the Data Policies.
1.3. We may update these Terms periodically. The version in force at the time you place your order or attend a consultation will apply.
2. OUR DETAILS
2.1. “Beth Macaulay Couture”, “we”, “us”, or “our” refers to the fashion design business trading under that name.
2.2. You may contact us via email, WhatsApp, phone, or our official social channels as set out on our contact page.
3. SCOPE OF SERVICES
3.1. We offer seasonal and non-seasonal ready-to-wear items and bespoke/made-to-order garments.
3.2. Consultations and fittings may occur in person or virtually, subject to availability.
4. CUSTOMER ELIGIBILITY & CONDUCT
4.1. Our products and services are available to local and international clients.
4.2. You undertake to provide accurate information (including measurements, contact details, and addresses). Failure to do so may delay production or delivery and incur additional fees (e.g., re-delivery, re-fitting, administrative costs).
5. PRODUCT INFORMATION & AVAILABILITY
5.1. Ready-to-wear pieces are produced in limited runs. Once a fabric/colour is sold out, it may not be remade unless sourcing is feasible.
5.2. We reserve the right to withdraw or amend products or services at any time.
6. SIZING DISCLAIMER
6.1. Plus-size pricing: Garments from UK size 16 and above may attract a price adjustment due to fabric and labour requirements.
6.2. Measurements provided by you must be accurate. Alterations required due to inaccurate measurements supplied by you may incur additional fees.
7. COLOUR & FABRIC DISCLAIMER
7.1. While we aim for accurate representation, colour and texture may vary due to lighting, device displays, or sourcing.
7.2. A Colour & Fabric Verification Form will be completed before production. If fabric becomes unavailable, we will propose alternatives of comparable quality and value. Any approved change may affect price and timelines.
8. TIMELINES
8.1. Production timelines commence upon confirmation/collection of materials and receipt of any required deposit.
8.2. Timeline adjustments caused by late approvals, measurement changes, or client-initiated modifications may incur additional fees and revised delivery dates.
9. DISPATCH, RISK & EVIDENCE
9.1. Once an order is handed to a courier, the courier’s terms apply. Risk passes on the dispatch to the address provided.
9.2. Clients are advised to record an unboxing video upon receipt to evidence condition and completeness.
10. ALTERATIONS & FITTINGS
10.1. Items may be returned for alterations within 28 days of delivery/collection.
10.2. Alterations requested after 28 days are treated as a new order and will be charged accordingly.
10.3. Fittings missed or rescheduled with insufficient notice may incur additional fees (see Consultation Policy).
11. FEES, SURCHARGES & ADMIN CHARGES
11.1. In the following situations, additional fees may apply:
(a) client-initiated design changes after approval;
(b) repeat fittings due to inaccurate measurements provided by the client;
(c) fabric/trim upgrades or substitutions requested by the client;
(d) expedited/priority production or delivery;
(e) re-delivery due to wrong/changed address or missed delivery;
(f) processing, admin, or storage beyond agreed timelines.
11.2. Any such fees will be communicated in advance and must be settled before the release of the item.
12. STATUTORY RIGHTS
12.1. Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015 and applicable distance-selling rules for eligible online purchases.
